Provisions Common to Retail Installment Contracts and Retail Charge Agreements

§ 97.265 Insurance


If the cost of any insurance is included in the retail installment contract or retail charge agreement:


6. If the contract or agreement requires the buyer to procure and furnish insurance acceptable to the seller and the buyer fails so to provide or such insurance as procured by the buyer is canceled or expires, the seller may procure the insurance in such form as the seller may deem necessary, and the cost thereof together with a finance charge may be added to the unpaid total of payments.

§ 686A.200 Favored agent or insurer


2. Subsection 1 does not prevent:

(b) The exercise by the vendor, lender, lessor or provider of service of the right to furnish or renew the insurance, and to charge the account of the other person with the costs thereof, if such other person fails to deliver such insurance to the lender, vendor, lessor or provider of service, where otherwise called for and in order, at least 15 days prior to expiration of the existing policy.
