Indiana


The relevant statute is Indiana Uniform Consumer Credit Code, Ind. Code Ann. §§24-4.5-2-101 et seq. (IN-UCCC), 26-1-2-201, 32-2-1-1, 32-2-1.5-4.


A. Actions creditor may take: IN-UCCC §24-4.5-2-208(1) - If buyer covenants to insure the vehicle, and creditor, pursuant to the contract, pays for performance of buyer's covenants, then creditor may add the amount of the premium paid on buyer's behalf to the debt.


B. Notices required: IN-UCCC §24-4.5-2-208(1) - Within a reasonable time after creditor pays the premium, creditor must send a written notice to buyer of:

(i) the amount of the premium,

(ii) any charges with respect to the premium,

(iii) a revised payment schedule, and

(iv) a brief description of the insurance, including the type and amount of the coverage.


C. Charges permitted: No express statutory provision.


D. Finance charge allowed on creditor's payment: Yes. IN-UCCC §24-4.5-2-208(2) - A credit service charge may be made for the premiums paid by creditor at an interest rate not exceeding the contract rate disclosed to buyer
