Arizona: For licensees under the Mortgage Brokers and Mortgage Bankers, Ariz. Rev. Stat. §§6-901 et seq., loans of $10,000 or less are subject to Ariz. Rev. Stat. §6-635(A)(2) which provides that the actual costs of charges which are paid to a third party who is not an employee of the licensee and which are incurred in making real estate loans secured in whole or in part by a mortgage, deed of trust or other security instrument on real estate may be charged to the borrower. This statute does not expressly address insurance tracking fees. All other loans are unregulated by statute in Arizona.
