Louisiana: For licensees under the Residential Mortgage Lending Act, La. Rev. Stat. §§6:1081 et seq., La. Rev. Stat. § 6:1097A provides that the parties to a federally related mortgage loan may agree to the payment and the amount of fees, charges, costs and expenses, including but not limited to the types of fees, charges, costs and expenses identified in LA-RMLA §6:1097B, if the fees and charges are provided in a writing signed by the consumer. The fees identified in LA-RMLA §6:1097B(4) include fees, taxes, charges and other expenses incurred in making the loan which are collected from or paid by the borrower or on his behalf, if the fees, taxes, charges and other expenses are actually paid to or are payable to persons other than the lender or the person making the loan or any employee of such lender or person making the loan. The statute does not expressly address insurance tracking fees.
